LearningTime Canada creates personalized learning paths for children from prenatal development through age 10. We harness the power of artificial intelligence to craft custom children's books and educational content tailored to each child's unique learning style, interests, and developmental stage. Our mission is to foster a lifelong love for learning by making education a personal, engaging, and enjoyable journey for every child.

3. Services Offered

3.1 Personalized Books

We create custom, one-of-a-kind children's books using AI technology, including:

          Custom ABC Read Aloud Books featuring your child's name and personalized content

          Age-appropriate personalized storybooks for children newborn to age 10

          Educational books designed to promote literacy, creativity, and learning

Each book is uniquely generated and cannot be exactly replicated.

3.2 Subscription Services

We offer subscription-based personalized learning paths with the following options:

Subscriptions provide access to age-appropriate personalized content, educational resources, and periodic delivery of custom books aligned with your child's developmental milestones.

3.3 Digital Products

We provide digital educational resources including:

          Interactive PDFs about early childhood development

          Digital versions of personalized books

          Educational content and learning materials

3.4 Physical Products

We produce and ship physical printed books customized with your child's information and personalized story content.

4. Eligibility and Account Registration

4.1 Age Requirements

You must be at least 18 years of age or the age of majority in your jurisdiction to use our Services. Our Services are intended for purchase by adults on behalf of children.

4.2 Account Creation

To access certain features of our Services, you may be required to create an account. You agree to:

          Provide accurate, current, and complete information

          Maintain and update your information to keep it accurate

          Maintain the security of your account credentials

          Notify us immediately of any unauthorized access

          Accept responsibility for all activities under your account

4.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct we deem inappropriate or harmful.

5. Ordering and Payment

5.1 Product Orders

When you place an order for personalized books or subscribe to our Services, you are making an offer to purchase. We reserve the right to accept or decline any order. Orders are subject to availability and our acceptance.

5.2 Pricing

All prices are listed in Canadian Dollars (CAD) unless otherwise specified. We reserve the right to modify pricing at any time. Price changes will not affect orders already placed and confirmed.

5.3 Payment Terms

Payment is required at the time of order or subscription purchase. We accept various payment methods as indicated on our Site. By providing payment information, you represent that you are authorized to use the payment method.

5.4 Subscription Billing

          Subscriptions are billed at the frequency selected at purchase (annually for multi-year subscriptions or as otherwise specified)

          Automatic renewal may apply to certain subscription plans unless cancelled prior to renewal

          You authorize us to charge your payment method for recurring subscription fees

          We will provide notice of upcoming charges and renewal dates

5.5 Taxes

Applicable taxes, including Goods and Services Tax (GST) and Provincial Sales Tax (PST), will be added to your order total as required by Canadian law.

6. Personalization and Content Creation

6.1 Information Provided

To create personalized products, you will provide information about the child, including:

          Child's name

          Age or birthdate

          Interests and preferences

          Other personalization details as requested

You represent that you have the right and authority to provide this information and consent to its use in creating personalized content.

6.2 AI-Generated Content

Our books and educational materials are created using artificial intelligence technology combined with human oversight. While we strive for high-quality, appropriate content:

          Each product is unique and generated specifically for your order

          Content may vary in style and presentation

          We review AI-generated content for appropriateness before delivery

          We cannot guarantee that every book will meet your exact expectations regarding artistic style or narrative approach

6.3 Content Review

We reserve the right to review and modify AI-generated content to ensure it meets our quality standards and is appropriate for children.

6.4 Accuracy of Information

You are responsible for ensuring that all information provided for personalization is accurate. We are not responsible for errors in personalized products resulting from incorrect information provided by you.

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Services, including the Site, software, designs, text, graphics, logos, and all content (excluding your personalized content), are owned by LearningTime Canada or our licensors and are protected by Canadian and international intellectual property laws.

You may not:

          Copy, modify, distribute, or reproduce our proprietary content

          Use our trademarks, logos, or branding without written permission

          Reverse engineer or attempt to extract source code from our Services

          Create derivative works based on our Services

7.2 Your Personalized Products

Personalized books created for you are for your personal, non-commercial use. You may:

          Use the personalized book for the intended child recipient

          Share the physical or digital book within your immediate family

          Display or read the book in home or educational settings

You may not:

          Resell or commercially distribute personalized products

          Reproduce or print additional copies for distribution

          Modify and redistribute the content

          Use the personalized content for commercial purposes

7.3 User-Provided Content

If you provide any content, feedback, suggestions, or ideas to us, you grant LearningTime Canada a perpetual, worldwide, royalty-free license to use, modify, and incorporate such content into our Services.

8. Privacy and Data Protection

8.1 Privacy Policy

Your privacy is important to us. Our collection, use, and protection of personal information, including children's information, is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8.2 Children's Information

We take the privacy and safety of children seriously. We collect only the minimum information necessary to create personalized products and comply with applicable privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and provincial privacy legislation.

8.3 Parental Consent

By providing a child's information, you represent that you are the parent or legal guardian of the child and have the authority to consent to our collection and use of their information.

9. Shipping and Delivery

9.1 Physical Products

          Physical books are shipped to Canadian addresses

          Shipping times vary based on location and production schedule

          Estimated delivery times are provided at checkout but are not guaranteed

          Risk of loss passes to you upon delivery to the shipping carrier

9.2 Digital Products

Digital products are delivered electronically to the email address provided. You are responsible for ensuring your email address is accurate and that you can receive our emails.

9.3 Production Time

Personalized products require creation time. Typical production times are communicated at the time of order, but may vary based on order volume and complexity.

10. Returns, Refunds, and Cancellations

10.1 Personalized Products

Due to the custom, personalized nature of our products:

          Returns are generally not accepted for personalized books unless there is a production error or defect

          Refunds will be provided if we cannot fulfill your order or if the product is defective

          If you are unsatisfied due to a production error, contact us within 14 days of receipt

10.2 Subscription Cancellations

          You may cancel your subscription at any time by contacting customer support

          Cancellations will take effect at the end of the current billing period

          No refunds will be provided for partial subscription periods already paid

          Multi-year subscriptions paid in full are non-refundable except as required by law

10.3 Defective Products

If you receive a defective product, contact us within 14 days with photographic evidence. We will, at our discretion:

          Replace the defective product at no charge

          Issue a full or partial refund

          Provide store credit for a future purchase

10.4 Order Cancellations

Orders may be cancelled before production begins. Once production has started, orders generally cannot be cancelled. Contact us as soon as possible if you need to cancel an order.

11. Disclaimers and Limitations of Liability

11.1 Educational Purpose

Our products are designed to support early childhood learning and literacy. They are not a substitute for professional educational advice, therapy, or medical services. Consult qualified professionals regarding your child's specific educational or developmental needs.

11.2 No Warranties

THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

          The Services will be uninterrupted or error-free

          Defects will be corrected

          The Services are free from viruses or harmful components

          Results from using our products will meet your expectations

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEARNINGTIME CANADA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless LearningTime Canada, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

          Your violation of these Terms

          Your use of the Services

          Your provision of inaccurate or unauthorized information

          Your violation of any rights of another party

13. Prohibited Conduct

You agree not to:

          Use the Services for any unlawful purpose

          Provide false or misleading information

          Impersonate any person or entity

          Interfere with or disrupt the Services or servers

          Attempt to gain unauthorized access to our systems

          Use automated systems (bots, scrapers) to access the Services

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

You agree to submit to the exclusive jurisdiction of the courts located in Edmonton, Alberta for resolution of any disputes arising from these Terms or the Services.

16.3 Informal Resolution

Before initiating any legal proceeding, you agree to first contact us to attempt to resolve the dispute informally. We will make good faith efforts to resolve disputes amicably.

16.4 Limitation Period

Any claim or cause of action arising from these Terms or the Services must be filed within one (1) year after the claim arose, or it will be permanently barred.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and LearningTime Canada regarding the Services.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

17.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

17.4 Assignment

You may not assign or transfer these Terms or your rights under them without our written consent. We may assign these Terms without restriction.

17.6 Force Majeure

Provisions of these Terms that by their nature should survive termination will survive, including intellectual property rights, disclaimers, limitations of liability, indemnification, and dispute resolution provisions.
